J. McLane Layton, the executive director of EACH and co-author of the Child Citizenship Act of 2000 (the legislation that gives automatic US citizenship to IR3 visa kids) will be interviewed at 8:00 p.m. EST regarding current international adoption issues by Susan Allan (wife to former Virginia Senator Allen) who has a radio show on this station in Detroit, MI.

McLane is currently working on re-introducing the ICARE legislation to the U.S. House of Representatives. This legislation is very detailed and calls for streamlining the U.S. immigration approval process by creating one adoption office, instead of having the State Dept. and USCIS working on adoptions.

Also, it would allow adoptive parents to register their children's adoption decrees at the U.S. Embassy and obtain a "citizen born abroad" certificate (like the ones that children born outside the U.S. to U.S. citizens receive now), so that the adopted child can travel on a U.S. passport because his/her U.S. citizenship right is fully recognized...etc.

Hello Vera , here in Canada since december23rd 2007, we have this kind of law!! I was really happy with it because I thought I would have one step less!! But in fact, it seems that even if the child is a canadian citizen after the jugement, it seems that at the airport they will not let the child go without a Haitien passeport, so the avantage is looking to do notting to ease the process we still have to go true MOI . That is what was said to my agency until now!

I know about the Canadian law. I actually need an official citation for that law because I am discussing it in my law review article (it is still in draft form). So if you could send that to me that would be great.

The law about the US Passport is not just for Haiti, it is for all other countries as well.

By the way, I am curious as to why the Canadian Embassy says that. I go to Haiti with my Haitian adopted daughter who has a U.S. passport now that she travels on. When we leave, at the airport the IBESR person always tries to stop me, "Adoption?" --- All that I ever do is flash my daughter's U.S. Passport and they back right off. They do not have the right to prevent a Haitian born child who has a U.S. passport from leaving the country.

I think that when you get in the country of Haiti , you have to file a green paper that you need to get back home, so if you child has a passeport but not this paper can't get out!

I have the website address, but I do not have the actual citation for the law. I need the actual citation the way it is written in the "lawbooks".

For Example the U.S. Immigration and Alien Act's formal citation is "8 USC § 1101".
